Yana Gubskaya, judge of the Kyiv court
Gabyshev Dmytro Oleksandrovych, born on August 07.08, 2001, found guilty of committing a crime. Part 3 of Article 206 of the Criminal Code of Ukraine is envisaged and he will be sentenced under Part 3 of Article 206 of the Criminal Code in the form of 9 years of imprisonment with deprivation of the right to drive a vehicle for a period of 3 years.
Dmitry Gabyshev was sentenced today in the Kyiv court. In October last year, a 19-year-old boy was responsible for a fatal accident. Then he got behind the wheel drunk, violated traffic rules and jumped into the oncoming lane. As a result of the collision, an employee of GSChS died together with his 15-year-old daughter.
Dmitry admitted his guilt in full, but refused to communicate during the meeting. In addition to 9 years in prison, Gabyshev must be paid moral compensation, which is two million hryvnias.
A representative of the victims says that they demanded that Gabyshev be sentenced to 10 years, so they do not agree with the verdict and will file an appeal.
Evgeny Melnichenko, representative of the victims
We emphasized that compensation was not a way to mitigate punishment. In our opinion, the point of view of the victims cannot be assessed with money. We filed a monetary lawsuit as one of the ways to punish Gabyshev.
Lyubov Azarenkova, who lost her entire family in the accident, is also not satisfied with the court's decision.
Love Azarenkova, the victim
What you have done to me and continue to do. I won't let you out sooner. Did you remember those words? Here, look what you did. You will be 29 years old when you leave.
The prosecutor's office noted that they now plan to get acquainted with the court's decision and find out why the court sentenced Dmitry to only 9 years.
The guilt was proved completely. There is all the evidence, the involvement of a person in this criminal offense, involvement in driving, ie he drove this vehicle, which is proved in the materials of the criminal proceedings. There is no doubt about guilt.
In addition, Gabyshev was deprived of his driver's license for three years.
